رياض سلامة و”آخرون” إلى مسار قضائي طويل
لم يكن إصدار مذكرة توقيف وجاهية في حق الحاكم السابق لمصرف لبنان رياض سلامة أمس سوى مؤشر “جدي للغاية”، وفق المعطيات المتوافرة لـ”النهار”، إلى فترة توقيف طويلة انطلق معها مسار قضائي لا يمكن الجزم استباقياً بإطلاق التوقعات حول نتائجه من الآن. ذلك أن تحديد جلسة ثانية للتحقيق مع سلامة الخميس المقبل سيطلق على الأرجح سلسلة استجوابات إضافية لشهود وأشخاص يدورون في حلقة التحقيق الجاري في ما سمي أموال “الاستشارات” البالغة 42 مليون دولار، وهو الأمر الذي لا يزال يحصر ملف توقيف سلامة والشروع في التحقيق معه وإصدار مذكرة توقيف في حقة في هذا الملف حصراً من دون سواه.
وبذلك سيكون من التسرع، وفق المعطيات نفسها، التكهن بان تتطور عملية التحقيق في هذا الملف إلى ملفات أخرى ذات صلة بواقع الانهيار المالي وملف المودعين، أقله راهناً وإلى أن يتبلور مسار التحقيق والمراحل اللاحقة منه. إذ لا شيء يحول دون أن يمضي قاضي التحقيق الأول في بيروت بلال حلاوي في جلسات إضافية بعد الخميس لإنهاء استجواباته قبل تحويل الملف إلى النيابة العامة المالية لإبداء مطالعتها ومن ثم إصدار قاضي التحقيق الأول قراره الظني وتحويله إلى محكمة الجنايات. وسادت توقعات بعد صدور مذكرة التوقيف بأن يجري استدعاء ثلاثة محامين من المقربين من سلامة للاستماع إلى إفاداتهم في الملف قيد التحقيق.
إذن هي السابقة الأولى في لبنان التي صار فيها الحاكم السابق لمصرف لبنان موقوفاً رسمياً أمس بموجب مذكرة التوقيف الوجاهية التي أصدرها القاضي حلاوي، فيما ستتجه الأنظار إلى جلسة الخميس المقبل وما سيقوله الشهود، والأهم من ذلك حضور الدولة طرفاً في الادعاء ممثلة برئيسة هيئة القضايا في #وزارة العدل القاضية هيلانة إسكندر.
ونقل سلامة في موكب أمني من مكان توقيفه في المديرية العامة لقوى الأمن الداخلي إلى قصر العدل في بيروت، وسط إجراءات أمنية مشددة للغاية حالت دون وصول المتظاهرين الذي تداعوا لمواكبة جلسة الاستجواب الأولى، وحاولوا الوصول إلى الموكب. لكن القوى الأمنية حالت دون وصولهم، وكان النائب إلياس جرادة وعدد من المحامين الذين تقدموا بادعاء ضد سلامة بين المعتصمين.
وخلال الجلسة التي استمرت نحو ثلاث ساعات في حضور وكيل سلامة المحامي مارك حبقة، سمعت الأصوات إلى خارج القاعة، ولم يقبل طلب رئيسة هيئة القضايا في وزارة العدل القاضية هيلانة إسكندر بالمشاركة في جلسة الاستجواب، وبالتالي لم تكن الدولة طرفاً في الادعاء. والوقت الطويل نسبياً للاستجواب عكس جدية كبيرة في متابعة القضية. لكن الحاكم السابق قد يستأنف قرار توقيفه أمام الهيئة الاتهامية خلال 24 ساعة من صدور مذكرة التوقيف الوجاهية، إلا أنه يمكن النيابة العامة أن تستأنف قرار الهيئة الاتهامية في حال صدوره مغايراً لاستمرار توقيفه.
ومن المفترض أن تشهد جلسة الخميس المقبل الاستماع الى شهود من مستشارين قانونيين سابقين وحاليين للمصرف المركزي. وستحضر الدولة عبر القاضية إسكندر، لا سيما وأن عدم حضورها الجلسة أمس كان سببه أن الادعاء من النيابة العامة المالية وليس من الدولة. غير أن جهات سياسية وقانونية تحدثت عن أن نقابة المحامين لم تكن قد ردت بعد على طلب رفع الحصانة عن محاميين مطلوبين للاستماع إلى اقوالهما في الملف.

**Riad Salameh and ‘Others' Face Lengthy Legal Proceedings**
The issuance of an arrest warrant against the former Governor of the Central Bank of Lebanon, Riad Salameh, marks a significant and “highly serious” development, according to information obtained by “An-Nahar.” This is expected to lead to a long legal process, with the outcome still uncertain. A second session for Salameh’s interrogation has been scheduled for next Thursday, which is likely to trigger a series of additional interviews with witnesses and individuals linked to the ongoing investigation regarding the $42 million consultancy funds. For now, the case is focused solely on this matter, with no indication that it will expand to other issues, such as the broader financial collapse or the depositors' crisis.
It is considered premature, based on current insights, to predict whether the investigation will evolve into other related cases. For now, the focus remains on the specific investigation under Judge Bilal Halawi, who is expected to hold additional sessions after Thursday. These sessions will conclude before the case is referred to the financial prosecutor for review. Once this phase is complete, Judge Halawi may issue his indictment and refer the case to the criminal court. Following the arrest warrant, there were speculations that three lawyers close to Salameh might be summoned to provide their testimonies in the ongoing investigation.
This marks the first time in Lebanon's history that a former Central Bank governor has been officially detained under an arrest warrant issued by Judge Halawi. All eyes will be on next Thursday’s session to hear what the witnesses have to say, especially with the presence of the state, represented by Judge Helena Iskandar, head of the Legal Department at the Ministry of Justice.
Salameh was transferred under heavy security from his place of detention at the Internal Security Forces General Directorate to the Justice Palace in Beirut. Tight security measures were in place to prevent demonstrators, who had gathered to accompany the first interrogation session, from reaching the motorcade. Among the protesters were MP Elias Jaradeh and several lawyers who had filed a lawsuit against Salameh.
During the session, which lasted around three hours and was attended by Salameh’s lawyer, Mark Habka, voices could be heard outside the courtroom. Judge Iskandar’s request to participate in the interrogation session was denied, meaning the state was not officially part of the prosecution during the session. The length of the interrogation reflected the seriousness with which the case is being pursued. However, Salameh may appeal the arrest warrant before the indictment committee within 24 hours of its issuance. The public prosecutor may also appeal the committee’s decision if it rules against continuing his detention.
The upcoming session on Thursday is expected to include testimonies from former and current legal advisors to the Central Bank. The state, through Judge Iskandar, is expected to be present. The absence of state representation during the first session was due to the fact that the prosecution was initiated by the financial public prosecutor rather than the state itself.
